Children Under the Age of 16

The Services are not intended for children under 16 years of age.  No one under age 16 may use the Services, or provide any personal information to or on the Services. We do not knowingly collect personal information from children under 16. If you are under 16, do not use the Services or provide any information to us. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed or accessed by unauthorized persons.

Automatic Information Collection and Tracking

As you access or use the Services, we may use automatic data collection technologies to collect certain information, which may include:

Details about your device(s), equipment, connection, and other resources utilized in accessing or using the Services.

Stored information and files such as metadata and other information associated with files stored on your device(s).

Cookies.  A cookie is a small file placed on your device. It may be possible to refuse to accept cookies by activating the appropriate setting on your browser or device. However, if you select this setting you may be unable to access certain parts or features of the Services. Unless you have adjusted your settings to refuse cookies, the Services will issue cookies when you access the Services.

Beacons.  Pages or screens of the Services and our emails to you may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or screens or opened an email and for other related usage statistics (for example, recording the popularity of certain content and verifying system and server integrity).

Pixels. A tracking pixel, also known as a marketing pixel, is a pixel graphic used to track user behavior, site conversions, web traffic, and other metrics similar to a cookie. It may be used for targeting or retargeting purposes.

When you navigate to our Websites, tracking technologies such as Google Analytics use cookies and other, similar technologies, to collect information about how users use the website. The information generated by the cookie about your use of the Website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of our website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Your State Privacy Rights

Colorado, Connecticut, Utah, and Virginia

Colorado, Connecticut, Utah, and Virginia provide their residents with certain additional rights and protections with regard to their personal information.  In addition to the notice and disclosures set forth above, the following specific terms apply to Colorado, Connecticut, Utah, and Virginia residents and their personal information:

Right to Confirm, Have Access, and Data Portability. You have the right to confirm whether we process your personal information. You have the right to request access to and/or obtain a copy of any personal information we may hold about you.

Right to Correct. You have the right to request that we correct inaccuracies in your personal information.

Right to Delete. You have the right to request that we delete personal information we have collected from or obtained about you.

Right to Opt Out of Sales. You have the right to opt out of sales of your personal information.

Right to Opt Out of Profiling. You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Right to Opt Out of Targeted Advertising. You have the right to request that we stop disclosures of your personal information for targeted advertising. In addition, you have the right to opt out from processing of your personal information for the purpose of targeted advertising to you.

SUPPLEMENTAL PRIVACY POLICY FOR CALIFORNIA RESIDENTS

This Supplemental Privacy Policy for California Residents supplements the information contained in CPT's Privacy Policy Notice, above, and applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018, as amended, including through the California Privacy Rights Act and all implementing regulations (collectively the "CCPA") and any terms defined in the CCPA have the same meaning when used in this policy. 

This policy does not apply to workforce-related personal information collected from California-based employees, job applicants, contractors, or similar individuals, which information is subject to a separate Employment Privacy Notice.

As described in our Privacy Policy Notice, above, we may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (generally "personal information"). Personal information does not include:

We do not sell your personal information.

We may disclose your personal information with our contractors and service providers in connection with the operation of our business, as well as sharing your personal information with third parties in connection with analytics, tracking, targeted advertising and cross-contextual behavioral marketing as described herein.

These third parties may associate cookies and other tracking technologies that collect personal data about you on our services, or otherwise collect and process personal information that we make available about you, including digital activity information.

Reselling Personal Information

The CCPA prohibits a third party from reselling personal information unless you have received explicit notice and an opportunity to opt-out of further sales. We do not authorize third parties to resell your personal information.

Sensitive Personal Information

We collect and use these categories of sensitive personal information for the legitimate business purposes described above. We do not collect sensitive personal information for the purpose of inferring characteristics about you and we also do not use or disclose sensitive personal information 

Retaining Personal Information

The length of time that we retain each category of personal information will depend on a number of criteria, including (i) the length of time we are required to retain personal information in order to comply with applicable legal and regulatory requirements, (ii) the length of time we may need to retain personal information in order to accomplish the business or commercial purpose(s) for which such personal information is collected, used or disclosed (as indicated in this Notice), and (iii) whether you choose to exercise your right, subject to certain exceptions, to request deletion of your personal information.

Your Rights and Choices

The CCPA provides consumers with specific rights regarding their personal information. This section describes your additional CCPA rights and explains how to exercise those rights.

Right to Know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the "right to know"). Once we receive your request and confirm your identity, we will disclose to you:

The categories of personal information we collected about you.

The categories of sources for the personal information we collected about you.

Our business or commercial purpose for collecting or selling that personal information.

The categories of third parties with whom we share that personal information.

If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

sales, identifying the personal information categories that each category of recipient purchased; and 

disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained. 

The specific pieces of personal information we collected about you (also called a data portability request).

Right to Delete 

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to: 

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Debug products to identify and repair errors that impair existing intended functionality.

Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

Comply with a legal obligation.

Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action. 

Right to Correct

You have the right to request that we correct personal information that we maintain about you if you believe it is inaccurate. We may request documentation to validate request and will use reasonable efforts to correct the personal information. In certain applications, you can also correct certain personal information we maintain about you by logging into your account and editing your profile or account information.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. 

You do not need to create an account with us to submit a request to know or delete.

We will only use personal information provided in the request to verify the requestor's identity or authority to make it. 

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at our toll free number at 877-708-3887or by email at Serve1@serveshop.xyz. 

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. 

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

Opt-Out Rights

CCPA provides you the right to opt out of various processing, use, and disclosures of your personal information, as follows.  You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Other California Privacy Rights

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
